Vaccine Compensation Act Claims

Although the majority of people who receive vaccines never have a problem more than must a minor sore arm for a day or so, or maybe a day of feeling lethargic as though they are coming down with the flu. Occasionally, someone has an extreme reaction. Perhaps an allergic reaction that results in long term physical damage.


In order to be responsive to those who were physically damaged as the result of their reaction to a vaccine, the U.S. Health Resources & Service Administration (HRSA) established a National Vaccine Injury Compensation Program (VICP) as a “no-fault alternative to the traditional legal system for resolving vaccine injury petitions.”

The good news is that anyone who received a covered vaccine can file a petition asking for damages for their injury. Parents, legal guardians, and legal representatives, can file on behalf of children, disabled adults, or for someone who died.


The not so good news is that it is a complicated procedure. Many forms have to be filled out, many questions answered, medical documentation provided, and still there is a waiting time.
